I wish I was kidding. This really did happen. I guess that the apple juice was right next to the margarita mix and a toddler was accidentally given the margarita mix instead. The toddler ended up in the hospital. The restaurant is paying all of the medical bills and I guess giving them some free meals too.
I personally think that margarita and apple juice looks completely different (and I have had a lot of margaritas in my time). Heck, they smell quite a bit different.

Having worked in restaurants, I know this happens, I've seen it.
It is so much easier to make the margarita mix in the morning than it is to make it as each order comes up.
But, we always kept our juices for kids in the back fridge, not at the bar.
The two containers were identical, which seems kind of dumb to start with. A lot of places now seem to be going toward jucie boxes. It completely eliminates the confusion.
Would I sue? It seems easy to say yes, but people are too sue-happy. The Applebee's offered (and is going) to pay ALL medical bills and I'm sure they want to satisfy this family because they would lose badly in court, not to mention the PR nightmare it has become. As long as my child was going to recover okay, I would not sue. But I would take free dinners for quite awhile.
I understand that accidents happen… thankfully everything is going to be ok. Had something worse occured, then a lawsuit would be for sure be pursued. I can't say what I would do as far as sueing.
It's not the first time I've heard of that happening. Someone I know from a message board had it happen to her son, but she tasted the drink before he got to it.
They should pay the bills and satisfy the family, and take whatever steps needed to insure it can't happen again.

I would not sue. There is a clear case for parental deralliction of duty in this one. It would be a good idea for the restaurant to bend over backwards for the parents however.

I don't usually advocate sueing. But I don't think I would be eating at that Applebee's anymore. 🙂

They restaurant really should have had a way to easily identify the apple juice from the margarita…
If they, for some reason, decided to store them in the same location they should have at least found a way to clearly mark them.
As long as the toddler was okay in the end, I wouldn't sue, but I would definitely make use of the free dinners.
